SC On Dissolution Of Marriage: सुप्रीम कोर्ट ने आपसी सहमती से तलाक पर सुनाया बड़ा फैसला, वेटिंग पीरियड भी जरूरी नहीं
सुप्रीम कोर्ट ने आपसी सहमति से तलाक पर बड़ा फैसला सुनाया. सुप्रीम कोर्ट ने फैसला सुनाया है कि यह संविधान के अनुच्छेद 142 के तहत अपनी विशेष शक्तियों का उपयोग करके विवाह के अपरिवर्तनीय टूटने के आधार पर तलाक दे सकता है.
सुप्रीम कोर्ट ने आपसी सहमति से तलाक पर बड़ा फैसला सुनाया. सुप्रीम कोर्ट ने फैसला सुनाया है कि यह संविधान के अनुच्छेद 142 के तहत अपनी विशेष शक्तियों का उपयोग करके विवाह के अपरिवर्तनीय टूटने के आधार पर तलाक दे सकता है, भले ही यह वर्तमान में तलाक के लिए मान्यता प्राप्त कानूनी आधार नहीं है. कोर्ट ने आगे कहा कि आपसी सहमति से तलाक के लिए 6 महीने की अनिवार्य प्रतीक्षा अवधि को शर्तों के अधीन समाप्त किया जा सकता है.
सुप्रीम कोर्ट ने कहा कि अगर संबंधों को जोड़ना संभव न हो, तो अदालत सम्पूर्ण न्याय के लिए अनुच्छेद 142 के तहत मिले अधिकारों के जरिए दखल दे सकती है. इतना ही नहीं कोर्ट ने कहा, आपसी सहमति से तलाक के लिए लागू 6 महीने इंतजार की कानूनी बाध्यता भी जरूरी नहीं है.
