न्यायमूर्ति प्रतिभा एम सिंह ने कहा है कि केवल इस आधार पर उल्लंघन करने वालों को टेलीग्राम की नीतियों के तहत शरण लेने की अनुमति नहीं दी जा सकती है कि इसके भौतिक सर्वर सिंगापुर में स्थित हैं.
दिल्ली उच्च न्यायालय (Delhi Highcourt) ने माना है कि मोबाइल मैसेजिंग प्लेटफॉर्म, टेलीग्राम (Telegram) को भारतीय कानून का पालन करना होगा और आईपी पते, मोबाइल नंबर और कॉपीराइट उल्लंघन (Copyright Infringement) में शामिल ऑपरेटिंग चैनलों में उपयोग किए जाने वाले उपकरणों जैसे विवरणों का खुलासा करना होगा यदि भारतीय अदालतों द्वारा आदेश दिया गया हो.
न्यायमूर्ति प्रतिभा एम सिंह ने कहा है कि केवल इस आधार पर उल्लंघन करने वालों को टेलीग्राम की नीतियों के तहत शरण लेने की अनुमति नहीं दी जा सकती है कि इसके भौतिक सर्वर सिंगापुर में स्थित हैं.
कोर्ट ने कहा कि अगर इस तरह के तर्क को स्वीकार कर लिया जाता है, तो मौजूदा दुनिया में जहां ऑनलाइन मैसेजिंग सेवाओं और प्लेटफार्मों के माध्यम से सबसे अधिक प्रसार होता है, बौद्धिक संपदा (आईपी) उल्लंघन पूरी तरह से अनियंत्रित हो जाएगा.
