PMO के अवर सचिव द्वारा दायर हलफनामे में कहा गया है कि PM CARES फंड को एक सार्वजनिक धर्मार्थ ट्रस्ट के रूप में स्थापित किया गया है और यह भारत के संविधान या संसद या किसी राज्य विधानमंडल द्वारा या उसके तहत नहीं बनाया गया है.
प्रधानमंत्री कार्यालय (PMO) ने दिल्ली हाई कोर्ट को सूचित किया है कि पीएम केयर फंड भारत के संविधान के अनुच्छेद 12 के तहत "राज्य" नहीं है और सूचना के अधिकार अधिनियम, 2005 के तहत "सार्वजनिक प्राधिकरण" के रूप में गठित नहीं है. PMO के अवर सचिव द्वारा दायर हलफनामे में कहा गया है कि PM CARES फंड को एक सार्वजनिक धर्मार्थ ट्रस्ट के रूप में स्थापित किया गया है और यह भारत के संविधान या संसद या किसी राज्य विधानमंडल द्वारा या उसके तहत नहीं बनाया गया है.
