SC On Marital Relationship and Divorce: सुप्रीम कोर्ट ने माना है कि तलाक के लिए हिंदू विवाह अधिनियम की धारा 13 (1) (ia) के तहत विवाह के अपरिवर्तनीय टूटने को "क्रूरता" के आधार के रूप में माना जा सकता है और इस आधार पर तलाक मंजूर किया जा सकता है.

जस्टिस सुधांशु धूलिया और जेबी पर्दीवाला की पीठ ने यह टिप्पणी एक ऐसे मामले में की, जिसमें एक जोड़ा 25 साल से अलग रह रहा था. दंपति बमुश्किल चार साल तक पति-पत्नी के रूप में साथ रहे, जिसके बाद वे अलग हो गए. इनके द्वारा एक-दूसरे के खिलाफ कई मामले दर्ज कराए गए थे.

फैमिली कोर्ट ने 2009 में क्रूरता के आधार पर पति की शादी तोड़ने की याचिका को स्वीकार कर लिया था, लेकिन दिल्ली हाई कोर्ट ने 2011 में तलाक के फैसले को पलट दिया. सुप्रीम कोर्ट ने पति की अपील पर विचार करते हुए कहा कि पिछले कुछ वर्षों में पक्षों के बीच संबंध कटु हो गए हैं.
