मध्य प्रदेश हाई कोर्ट ने हाल ही में माना कि पत्नी द्वारा अपने पति के साथ विवाह करने या शारीरिक संबंध बनाने से इंकार करना मानसिक क्रूरता है और यह पति के लिए हिंदू विवाह अधिनियम के तहत तलाक लेने का वैध आधार है.
मध्य प्रदेश हाई कोर्ट ने हाल ही में माना कि पत्नी द्वारा अपने पति के साथ विवाह करने या शारीरिक संबंध बनाने से इंकार करना मानसिक क्रूरता है और यह पति के लिए हिंदू विवाह अधिनियम के तहत तलाक लेने का वैध आधार है. न्यायमूर्ति शील नागू और न्यायमूर्ति विनय सराफ की खंडपीठ ने भोपाल की एक फैमिली कोर्ट के फैसले को रद्द कर दिया, जिसने नवंबर 2014 के अपने फैसले में एक ऐसे व्यक्ति को तलाक देने से इनकार कर दिया था, जिसने तर्क दिया था कि उसकी पत्नी यौन संबंध बनाने से इनकार करके उसे मानसिक क्रूरता का शिकार बना रही थी.
