मध्य प्रदेश हाईकोर्ट की जबलपुर पीठ ने हाल ही में कहा था कि आधार कार्ड एक नाबालिग रेप पीड़िता की आयु निर्धारित करने का प्रमाण नहीं है.
Aadhaar Not Proof to Determine Age Of Minor Rape Survivor: मध्य प्रदेश हाईकोर्ट की जबलपुर पीठ ने हाल ही में कहा था कि आधार कार्ड एक नाबालिग रेप पीड़िता की आयु निर्धारित करने का प्रमाण नहीं है. न्यायमूर्ति विवेक अग्रवाल ने कहा कि नाबालिग बलात्कार पीड़िता की उम्र निर्धारित करने के लिए अदालतों को किशोर न्याय (बच्चों की देखभाल और संरक्षण) अधिनियम के तहत निर्धारित प्रक्रिया पर विचार करना होगा.
पीठ ने कहा कि "जेजे एक्ट किसी व्यक्ति की आयु निर्धारित करने के लिए जन्म प्रमाण पत्र और स्कूल छोड़ने के प्रमाण पत्र पर निर्भर होने का प्रावधान करता है. बेंच ने कहा कि उन दस्तावेजों की अनुपस्थिति में, अधिनियम में किसी व्यक्ति की उम्र निर्धारित करने के लिए अस्थि परीक्षण का प्रावधान है. इसलिए उम्र निर्धारण के लिए आधार कार्ड को आयु के प्रमाण के रूप में लेने का कोई प्रावधान नहीं है,
