HC on DNA Test Of Child: बॉम्बे हाईकोर्ट का फैसला, पितृत्व टेस्ट की मांग कर पिता बच्चे को भरणपोषण देने से इंकार नहीं कर सकता
बॉम्बे हाईकोर्ट की नागपुर खंडपीठ ने हाल ही में एक मामले की सुनाई करते हुए बड़ा फैसला सुनाया है. कोर्ट ने कहा कि एक बच्चे को असाधारण मामलों में पितृत्व परीक्षण से गुजरने का आदेश दिया जा सकता है. लेकिन भरणपोषण देने से इनकार नहीं किया जा सकता है.
Bombay High Court on DNA Test Of Child: बॉम्बे हाईकोर्ट की नागपुर बेंच ने हाल ही में भरणपोषण के भुगतान मामले में बड़ा फैसला सुनाया है. दरअसल महाराष्ट्र में रहने वाला एक शख्त अपनी पत्नी पर बेवफाई का आरोप लगाकर अलग रह रहा है. शख्स की पत्नी जब बेटे के लिए भरणपोषण की मांग की तो वह पितृत्व टेस्ट की मांग कर देने से बचना चाहता है. लेकिन कोर्ट ने मामले में आदेश दिया है कि बच्चे का पितृत्व टेस्ट की मांग कर वह भरणपोषण देने से नहीं बच सकता है. उसे बच्चे को भरणपोषण के लिए पैसे देने होंगे. बच्चे को भरणपोषण के लिए पैसे ना देने पड़े शख्स कोर्ट में मामले में याचिका दायर की थी. जिस याचिका को लेकर कोर्ट ने फटकार लगाते हुए याचिका भी ख़ारिज कर दी. हालांकि कोर्ट ने कहा कि असाधारण मामलों में पितृत्व परीक्षण से गुजरने का आदेश दिया जा सकता है.
