Allahabad High Court: तलाकशुदा मुस्लिम महिला दूसरी शादी करने तक गुजारे भत्ते का दावा कर सकती है, HC का बड़ा फैसला
इलाहाबद हाई कोर्ट ने तलाकशुदा मुस्लिम महिला के एक मामले में सुनवाई करते हुए बड़ा फैसला सुनाया है. कोर्ट अपने फैसले में कहा कि तलाकशुदा औरतें 'इद्दत' की अवधि के बाद भी दूसरी शादी तक गुजारा भत्ता पा सकती हैं
इलाहाबद हाई कोर्ट (Allahabad High Court) ने तलाकशुदा मुस्लिम महिला के एक मामले में सुनवाई करते हुए बड़ा फैसला सुनाया है. कोर्ट अपने फैसले में कहा कि एक तलाकशुदा मुस्लिम महिला इद्दत की अवधि समाप्त होने के बाद भी जब तक वह पुनर्विवाह नहीं करती, सीआरपीसी की धारा 125 के तहत अपने पति से भरण-पोषण का दावा करने की हकदार होगी.”
इलाहाबाद हाईकोर्ट ने शबाना बानो बनाम इमरान खान के मामले में निर्धारित कानून को दोहराते हुए कहा कि एक तलाकशुदा मुस्लिम महिला इद्दत की अवधि समाप्त होने के बाद भी जब तक वह पुनर्विवाह नहीं करती, सीआरपीसी की धारा 125 के तहत अपने पति से भरण-पोषण का दावा करने की हकदार होगी.
